Income tax loophole for Ohio marijuana businesses?

ResponsibleOhio disagrees with Zaino’s reading of the proposed amendment. “It’s clear that our opponents are trying to come up with any reason they can, regardless of legitimacy, to justify their anti-marijuana reform agenda,” said Faith Oltman, a spokeswoman for ResponsibleOhio.

Marijuana businesses would have to pay a special flat tax on gross revenue, as well as the state commercial activities tax, according to Issue 3. For-profit marijuana companies also would pay “all other local taxes, assessments, fees and charges as apply to businesses in general.” The word “local” in that sentence could be a loophole because by definition that doesn’t include the state, said Zaino, who was tax commissioner from 1999 to 2003 under former Gov. Bob Taft.

That’s not the intent of the language, according to the ResponsibleOhio spokeswoman.
