Council directs staff to prohibit marijuana

Yucaipa City Council gave direction to staff to prohibit marijuana cultivation in all zones in the city in a special study session held Monday, Dec. 14.

The study session was held as a result of Governor Brown’s recent Medical Marijuana Reg­ulation and Safety Act, which essentially establishes state licensing requirements for the cultivation, distribution and transportation of medical marijuana. It allows for local control by cities.

If, by March 1, 2016, a city choses not to establish its own set of regulations or prohibits cultivating marijuana, then the state will become the licensing authority.

Prior to the MMRSA, in 1996, the state approved Prop­osition 215, the Compassionate Use Act of 1996, which gave individuals the right to cultivate marijuana under the care of a physician.

At least one individual in Yucaipa currently and legally grows marijuana under the eyes of code and law enforcement.
