The Montana Supreme Court declined to step into the criminal case of a Montana medical marijuana patient who is challenging the possession limit statute.

The case of 65-year-old Wayne Steven Penning, who faces a felony count of criminal possession of dangerous drugs with intent to distribute, is still pending in Yellowstone County District Court.

In January, Penning had asked the Supreme Court to take over the case to consider his request to dismiss the charge. He argued that the medical marijuana statute, which limits cardholders to possession of one ounce of "usable" marijuana, is too vague. 

Penning was arrested for exceeding that limit in 2015 when a Montana Highway Patrol trooper stopped him with harvested marijuana from four of his plants. 

The Georgia state Senate on Thursday overwhelmingly passed a bill that would expand the state's limited medical marijuana law to include people with 15 medical conditions, up from nine currently.

The bill now goes to Governor Nathan Deal to sign into law.

Unlike many other U.S. states that have medical marijuana laws that allow smokable and edible forms of cannabis to be used by people who have a wide range of conditions, Georgia only allows cannabis oil and even then, for a limited number of maladies.

The state Senate passed the expansion by a 45-6 vote. The measure was earlier approved by Georgia's House of Representatives.

Ohio Gov. John Kasich discounted recent studies and state lawmakers from both parties on Thursday when he said his state’s medical marijuana program would not help alleviate its opioid crisis.

While at a news conference announcing new limits on opioid prescriptions, a reporter asked Kasich what role medical marijuana might play in reducing the increasing number of opiate overdose deaths in Ohio, according to Cleveland.com.

Cannabis prohibition at the federal level could soon come to an end thanks to congressional legislation introduced Thursday morning to remove cannabis from the federal Controlled Substances Act and instead regulate and tax it similarly to alcohol.

US Sen. Ron Wyden (D-OR) and House Rep. Jared Polis (D-CO) introduced the bills, which end federal prohibition, allow states to decide whether to legalize, and impose certain federal regulations on cannabis businesses in legal states.

The Senate bill would also put in place a federal excise tax on cannabis products. In the House, a cannabis tax is being floated as a separate measure, introduced by Rep. Earl Blumenauer (D-OR).

Federal legislators are working on a cluster of proposed laws aimed easing the growing conflict between state and federal marijuana laws, with a number of protections and new regulations that could impact cannabis consumers and businesses in California.

Delaware's first bill to legalize recreational marijuana is expected to be unveiled today.

The draft legislation reportedly would allow state residents 21 and older to purchase up to an ounce of cannabis from dozens of stores authorized to sell the drug, which is now limited only to patients enrolled in the state's medical marijuana program.

The bill is expected to be formally introduced by chief sponsors Rep. Helene Keeley and Sen. Margaret Rose Henry, both Wilmington Democrats.

Henry, who penned Delaware's 2011 medical marijuana bill, first announced plans to seek legalization for recreational consumption last fall.
