DPTV: Activists share plan for Denver pot consumption and more

 

The same activists who in 2012 successfully legalized the cultivation, sale and use of recreational marijuana in Colorado have started their next big initiative: The push to allow pot consumption in places now off limits.

 

Activists want a measure on the November 2015 Denver ballot that asks voters to OK allowing marijuana consumption in commercial establishments, including bars and clubs, that meet certain guidelines.

They hope to get the question approved by the clerk and recorder’s office and gather more than 4,700 signatures before summer’s end.

Earlier this week, the Colorado Supreme Court unanimously confirmed that although medical marijuana is legal, employers have the power to fire workers if they fail company-sponsored drug tests. Earlier this week, the Colorado Supreme Court handed down a ruling that one attorney says “may serve as a roadmap” for other courts—and employers—navigating the gray areas surrounding medical marijuana laws.

On Monday, the state high court’s 6-0 decision in Coats v. Dish Network determined that an organization can terminate an employee for using medical marijuana, even if said marijuana use occurs while off-duty.

The marijuana industry has a pesticide problem. Many commercial cannabis growers use chemicals to control bugs and mold. But the plant's legal status is unresolved.

The grow room at Medical MJ Supply in Fort Collins, Colo., has all the trappings of a modern marijuana cultivation facility: glowing yellow lights, plastic irrigation tubes, and rows of knee-high cannabis plants.

"We're seeing a crop that's probably in it third or fourth week," says Nick Dice, the owner.

Colorado's governor opposed marijuana legalization. But it's going so well, he's changing.

Colorado Gov. John Hickenlooper (D) opposed the campaign to legalize marijuana in his state. But in a recent interview with CNN's Cristina Alesci, Hickenlooper seems to have warmed up to legalization after seeing its successful first year in Colorado, which was one of the first two states to legalize pot through a ballot initiative in 2012.

Less than one-sixth of adults in Colorado use marijuana

Despite marijuana legalization in the state of Colorado, a relatively small percentage of adults are currently consuming the drug.

According to new data from the state's Health Department, 13.6% of adults 18 years of age and older are current marijuana users, although it is only legal for adults 21 years and older to purchase and consume pot.

That's a pretty low figure, given that nearly half (48.9%) of adults 18 years and older in Colorado have used marijuana at one time or another.

An update on the cannabis oil controversy at Memorial Hospital. An eight year-old Monument girl will not be able to take it when she's at the hospital later this week.

11 News Reporter Katie Pelton first told you about the story over the weekend. She talked to the family again Monday.

Cora has a rare condition and takes cannabis oil twice a day as part of her daily regimen. But come Wednesday, she won't be able to take it while she's at Memorial Hospital undergoing surgery.

Cora's mother, Alicia Stier, tells 11 News she's frustrated with the hospital's decision. They told her Monday evening, Cora can't use cannabis oil during her stay Wednesday. They also said she could postpone the appointment to a later date.

As the Colorado Pot Guide web site recently noted, prices for legal cannabis have dropped significantly this year, due to the explosion of “grow only” operations across the state. That oversupply is good for consumers, but is forcing companies to lower their prices in order to remain competitive.

In one of the most highly watched marijuana cases in the country, the Colorado Supreme Court ruled Monday morning that companies can fire employees for smoking pot—even if it’s off-duty and despite the drug being legal in the state.

The decision poses a major setback for legalization proponents, as it sets the precedent that state marijuana laws do not override federal law that declares the drug to be illegal.

Patchwork of Pot Rules Hampers Marijuana Business Expansion

DENVER – Marijuana entrepreneurs rushing into the booming market are running headlong into a patchwork of state-by-state regulations that make it hard to transfer their expertise, brands and staff— and even their profits.

Because the federal government classifies marijuana as a Schedule 1 drug, states that have legalized medical or recreational marijuana have developed widely divergent rules governing their semi-legal marketplaces.

In Colorado, for instance, retailers until recently had been required to grow the majority of the marijuana they sell to customers. But Washington state bans retailers from growing their own cannabis, forcing them to buy from state-licensed farms.
