My friend Shona is a single mother who uses medical cannabis to treat her Crohn's disease, a chronic inflammatory condition of the gastrointestinal tract that is incredibly painful. Now she's fighting to keep custody of her son after the state of Kansas took him from her because she is a medical marijuana patient in a state where it isn't legal.

It all started last month when her 10-year-old son spoke out in school about the benefits of medical marijuana, explaining that it had saved his mom's life. Officials at the school called police who then searched her house and found medical marijuana and cannabis oil. She hasn't been charged with a crime, but authorities took her son away and put him in protective state custody.

As cannabis oil activist and Crohn's disease patient Shona Banda, who lost custody of her son and is facing over 30 years in prison after her son spoke out about her cannabis oil treatment during a school anti-drug presentation, surrendered herself to authorities, her attorney Sarah Swain said at a press conference that she intends to challenge cannabis' classification as a hardcore Schedule 1 narcotic with no medical use as a part of her defense of Banda and that she will take her case to the Supreme Court if necessary.

As she approached the Finney County Sheriff’s Office Monday, Shona Banda, the local medicinal marijuana advocate who gained national attention after the state took custody of her son, was surrounded by supporters, including Jennifer Winn, the Republican candidate who challenged Gov. Sam Brownback in last August’s primary.

Banda, accompanied by her attorney Sarah Swain and several others, turned herself in at the Law Enforcement Center at 2 p.m. Monday. Several local media outlets gathered outside along with other supporters.

Shona Banda, a Garden City mom who faces five charges related to marijuana use, appeared in court for the first time on Tuesday.

Those charges came after her 11-year-old son made comments about Banda using pot during an anti-drug program in his fifth-grade class at Bernadine Sitts School.

Eleven days after the incident, Garden City police and the Department for Children and Families questioned Banda’s son at school and raided Banda’s home in Garden City. Authorities took her son away and put him in protective state custody.

Curtis Jacobs, Finney County court administrator, said Banda’s first-appearance court records were still being processed as of Tuesday afternoon but should be released Wednesday.

On Friday, the state of Kansas charged Banda with “five felony counts of possession of marijuana with the intent to distribute, manufacturing Tetrahydrocannabinol, an oil extracted from marijuana, two counts of possession of drug paraphernalia and one count of child endangerment,” the Washington Post reports.
