Lawyer charged in marijuana operation case says state and federal laws ban prosecution

Arrested last year at his Denver law office, a Colorado attorney facing federal charges in connection with an alleged illegal marijuana operation says he shouldn’t be prosecuted.

That’s because state law permits him to do what he did and a federal budget amendment bans the use of federal funds to pursue the case, says attorney David Furtado. In fact, a motion filed last week by his counsel alleges, it is the Department of Justice that is violating the law, because the budget amendment effectively nixes federal prosecution of marijuana businesses operating legally under state law.

Excess marijuana revenue will stay with the state; Colorado passes Proposition BB

DENVER - Colorado voters approved Proposition BB in the Nov. 3 election, therefore deciding to let the state keep a surplus in pot tax revenue.

Proposition BB passed with 66 percent of votes in favor of it.

Colorado law required the vote because the revenue exceeded the initial estimate. The overall revenue was more than voters approved for a marijuana tax in 2013. TABOR requires a projection to be made in a tax’s first year.

Marijuana edibles recalled for potential pesticides

DENVER – Marijuana products delivered to 176 stores in Colorado were recalled for allegedly containing pesticide residue.

Gaia's Gardens, a Denver-based marijuana-infused manufacturing facility, voluntarily recalled potentially unsafe marijuana edibles. According to Denver's Department of Environmental Health, samples of marijuana candy from Gaia's Gardens contained three pesticides that cannot legally be used to grow marijuana in Colorado.

According to the City and County of Denver, the health impact of consuming the pesticides is unknown. They say there are potential short-term and long-term health impacts. So far, there have been no reports of illness.

The Department of Environmental Health asks anyone with recalled products to throw them away or return them.

Amercanex Announces New Leadership
