Amid a rash of medical marijuana cultivation bans, patients are cheering one potent legal victory this winter. Growing medical marijuana is not a crime, a California appeals court ruled earlier this month in a precedent-setting case. 

Cities and counties can cite patients in civil court for what amounts to nuisance violations, but the Health and Safety Code of California is clear: Qualified patients growing medical cannabis are not committing crimes.

Santa Paula planning panel backs marijuana rules

The sale, cultivation and delivery of medical marijuana soon could become expressly prohibited within the city of Santa Paula, strengthening a ban already in place.

The Santa Paula Planning Commission voted 3-0 Friday in support of a resolution that recommends changes to the city's municipal code. The changes, which must be approved by the City Council, would ban all commercial cannabis activity, mobile marijuana dispensaries, and cultivation and delivery of marijuana within the city.

Santa Paula's municipal code already prohibits the use of any building or real property for purposes prohibited by federal law, but does not explicitly refer to marijuana-related activities.

The proposed ordinance, if approved by the council, would make that prohibition clear.

TSA Worker Accused Of Smuggling Marijuana Through Oakland Airport

OAKLAND (CBS SF) — A Transportation Security Administration worker at the Oakland International Airport has been indicted for allegedly conspiring to smuggle marijuana through the airport, federal prosecutors said.

The indictment, which was unsealed on Thursday, also charges 28-year-old Kiana Scott Clark of San Mateo with conspiring to defraud the United States by obstructing, impeding, and interfering with the TSA’s aviation security functions, U.S. Attorney’s officials said.

According to the indictment, Clark allegedly used her position as a TSA officer to facilitate the smuggling of drugs into and through the Oakland airport for delivery throughout the U.S.
