Are Marijuana Businesses Legal in California?

Everyone can feel the changes taking place: marijuana, for better or worse, is gaining wider acceptance amongst the general public across the nation, despite its continued status as a controlled substance under the CSA. But where does this leave weed in the Golden State?

Or more importantly, where does this leave cannabis businesses in California? The law is shaky in this area. Maybe one of the best things lawyers can do is to become at least broadly familiar with the law and understand how we got here.

Kennedy Group Donates Millions To Keep California Marijuana Illegal, Faces Off With Millennials Over Pot

A national anti-marijuana group co-founded by former Rep. Patrick Kennedy has raised millions to defeat pot legalization initiatives in California and across the nation.

The anti-cannabis group, Smart Approaches to Marijuana, has raised more than $2 million and plans to donate the lion share to defeat California’s Proposition 64, which would legalize recreational pot in the state.

The group joins a growing number of California law enforcement agencies who argue legalizing marijuana would make the state more dangerous, Orange County Sheriff Sandra Hutchens told the Orange County Register.

The newest audits are focusing on Form 8300, which is the form used to report cash transactions of $10,000 or more. Doctors make easy money from medical marijuana. What happens when it's legal?

Frank Lucido, a California physician, received a phone call in 2012 from a doctor in Colorado.

Like Lucido – one of California’s best-known cannabis-friendly physicians – the Colorado doctor had been writing recommendations for medical marijuana, the paperwork required for patients to access cannabis at medical marijuana retail outlets in his state.

Unlike Lucido, the Colorado doctor was worried about the future of his practice.

There was a legalization measure on the ballot for recreational marijuana in Colorado that fall. If it passed, he was looking for somewhere to move, where he could continue writing recommendations in the semi-legal gray area of medical cannabis.

John Malkovich to Star in Marijuana Drama Series

Set up at Sony Pictures TV, 'Humboldt' hails from the producers of 'True Detective.'

John Malkovich is joining the Pot TV trend.

The Oscar-nominated actor has been tapped to star in Humboldt, a drama series inspired by Emily Brady's best-selling book Humboldt: Life on America's Marijuana Frontier, The Hollywood Reporter has confirmed.

Written on spec by Michael A. Lerner (Love and Mercy), the project is set up at Sony Pictures Television and Anonymous Content (True Detective, Mr. Robot) and will be taken out to premium cable networks and streaming services.

Watch: California High Court Tells San Jose Medical Marijuana Dispensary to Pay Up


The State of California’s Sixth Appellate District Court ruled Friday that the medical marijuana dispensary Medimarts in San Jose, must pay the city $767,058 in taxes and late fees. Medimarts has not paid the Marijuana Business Tax (MBT) to the City of San Jose since May of 2012, according to the court filing. Dave Armstrong, president and founding member of Medimarts, says that paying the tax would acknowledge they are violating federal law by selling marijuana. “My next step is do whatever it takes to maintain my caregiver status for the 10,000 plus, active medical marijuana patients that we serve,” Armstrong says.
